I. Product and Service Offers

HaloScape offers digital health services and related subscription packages via its mobile application and website. These services may include, but are not limited to, health data interpretation, access to health professionals, and use of advanced application features.

Product and service descriptions, specifications, and availability are presented within the App and/or website. While we strive to provide accurate and up-to-date information, typographical errors or inaccuracies may occur. Such descriptions do not constitute medical advice.

All offers are valid only as long as they are accessible through the App or website and within any stated validity periods. No contract shall be formed until HaloScape confirms the order.

HaloScape reserves the right to modify, discontinue, or restrict access to any product or service at its discretion and without prior notice, unless mandatory consumer protection law provides otherwise.

II. Subscriptions and Billing

HaloScape offers certain services on a subscription basis through its mobile application and website. By subscribing, users acknowledge and agree to enter into a recurring billing agreement that will remain in effect until the subscription is either cancelled by the user or terminated by HaloScape.

 

Subscriptions may be billed on a monthly, annual, or otherwise specified basis. The applicable billing cycle and subscription fee are clearly displayed at the time of purchase and are also available within the user’s account settings. Charges will be applied immediately upon initiation of the subscription or, if applicable, at the conclusion of any promotional free trial period.

 

HaloScape currently accepts multiple forms of payment, including but not limited to Stripe-supported credit and debit cards (such as Visa, MasterCard, and American Express), Apple Pay, and Google Pay. By providing a payment method, users authorize HaloScape and its payment processors to charge all applicable fees on a recurring basis, in accordance with the selected subscription plan.

 

All prices are displayed in the local currency of the user’s selected region, when available. Where applicable, local taxes, including Value-Added Tax (VAT) or similar charges, will be calculated and presented at checkout. Any fees or charges arising from foreign currency conversions, exchange rates, or international transaction fees are the responsibility of the user and may be imposed by their financial service provider.

 

Users are required to maintain a valid and up-to-date payment method linked to their HaloScape account. In the event of a failed transaction whether due to insufficient funds, expired card details, or other technical reasons HaloScape reserves the right to retry payment within a reasonable period. If payment remains unsuccessful, the user’s access to the Services may be temporarily suspended or permanently terminated.

 

Where offered, free trials provide temporary access to subscription services at no charge. The duration and scope of any free trial will be disclosed prior to activation. Unless the user cancels their subscription before the end of the trial period, the subscription will automatically convert into a paid plan, and the registered payment method will be charged accordingly.

 

HaloScape may revise subscription pricing and included features from time to time. Users will be notified of any such changes in advance, either through email, push notification, or in-app messaging. Adjustments to pricing will apply only to future billing periods. Continued use of the Services following the effective date of revised pricing constitutes acceptance of the new terms.

III. Delivery and Cancellation

All HaloScape services are delivered electronically via the Application. Access to services will begin immediately upon completion of the purchase or, in the case of subscriptions, at the start of the designated subscription period. By completing a transaction, users acknowledge that digital services may be rendered immediately, and that delivery obligations are fulfilled upon activation.

 

Users may cancel their subscription at any time through the account settings in the App. Cancellation will take effect at the end of the current billing period, and users will continue to have access to the service until that time. No new charges will be applied after cancellation unless the user re-subscribes.

 

Certain services or features may be non-refundable, especially when they have been fully performed or consumed prior to cancellation. Users are encouraged to review the scope and terms of each service before purchase. Additional refund rules are provided in Section IV.

 

By initiating the use of a digital service immediately after purchase, the user agrees to waive any statutory withdrawal rights that may otherwise apply, to the extent permitted by applicable law.

IV. Refunds and Warranties

Refunds are not automatically granted and are generally not provided, except as required by applicable consumer protection laws or in the event of verified billing errors. Users who believe they are entitled to a refund should contact HaloScape via email at support@haloscape.health . Each request will be reviewed individually, and decisions will be made at HaloScape’s discretion in accordance with relevant legal obligations.

           

HaloScape offers its digital services and features “as is” and “as available,” without any express or implied warranties beyond those required by law. The insights, suggestions, or feedback generated through the HaloScape App are provided for general informational purposes only and do not constitute medical diagnosis or treatment. Users should always consult a licensed healthcare professional before making any medical decisions.

           

For users located in the European Union or other jurisdictions where statutory consumer protections or digital service warranty rights apply, such rights shall remain fully intact and unaffected by these Terms. These include, but are not limited to, the right to a remedy in the event of non-conformity of digital services, where mandated by local law.

V. Withdrawal Rights

Users residing in the European Union or jurisdictions with similar consumer protection frameworks may be entitled to withdraw from their subscription contract within fourteen (14) days of the initial purchase, in accordance with applicable law. This right allows users to cancel their subscription without providing any reason and receive a refund for any unused portion of the service.

 

The withdrawal right does not apply if the user has started using the digital service and, during the subscription process, has expressly acknowledged and agreed that they waive the right of withdrawal upon commencement of service delivery. This exception aligns with Article 16 of the EU Consumer Rights Directive for digital content and services.

 

To exercise the right of withdrawal, the user must send a clear and unambiguous statement to HaloScape, preferably via email to support@haloscape.health , or by postal mail if applicable. The statement must include the user’s name, contact details, the subscription in question, and the date of purchase. Upon valid withdrawal, HaloScape will process the refund in accordance with applicable consumer law.
