I. Definitions

Include key terms used throughout the document. Examples:

  • App: The mobile or web-based software application provided by HaloScape.

  • User: Any individual who accesses or uses the HaloScape services.

  • Professionals: A professional providing services via the HaloScape platform.

  • Services: Digital tools and functionalities offered through the App.

  • Account: The registered profile through which a User or Professionals accesses the platform.

  • Terms: Refers collectively to this document and any linked policies (e.g., Privacy Policy, Cookie Policy, etc.).

·       Subscription: A recurring service agreement between HaloScape and the User for continued access to digital services.

·       Digital Content: Any health insights, visualizations, or feedback generated by the App.

·       Billing Cycle: The designated period for charging subscription fees (e.g., monthly, annually).

·       Payment Method: A valid method of payment registered with the User’s account, such as credit card, Stripe, or Apple Pay.

·       Device: A compatible smartphone, smart watch, tablet, or web browser that meets minimum technical specifications for running the App.

·       Jurisdiction: The legal framework applicable to interpreting and enforcing these Terms.

II. Scope and Application

These Terms and Conditions (“Terms”) apply to all Users and Professionals who access or use the HaloScape mobile application (“App”) and associated digital services (collectively, the “Services”). By registering for an account, logging into the App, or otherwise making use of the Services provided by HaloScape, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms form a legally binding agreement between you and RealWorks Teknoloji A.Ş. (“HaloScape”).

 

The scope of these Terms includes, but is not limited to:

 

a)     The provision and use of all functionalities and features available in the App, including health data syncing, professionals-matching, and communication tools;

 

b)     The responsibilities and obligations of Users and professionals while interacting with the platform and each other;

 

c)     The limitations and exclusions of liability applicable to HaloScape, especially in regard to the use of the Services for non-medical purposes;

 

d)     The enforcement of data protection principles and consent requirements, as detailed in our Privacy Policy;

 

e)     The governance of any product-specific or supplemental terms that may apply to certain features, beta services, or subscription models. Where applicable, such terms will be clearly presented and will be deemed incorporated into these Terms by reference.

 

By continuing to use the Services, you confirm your agreement to comply with the current version of these Terms, including any updates or supplements communicated to you through the App, website, or email.

III. Eligibility

Use of the HaloScape App and its Services is strictly limited to individuals who are 18 years of age or older. By accessing, registering for, or using any part of the Services, you confirm that you meet this minimum age requirement and have the legal capacity to enter into a binding agreement under applicable law.

 

To ensure compliance, HaloScape implements age verification mechanisms during the registration process. Users are required to provide their accurate date of birth, and the system will prevent the creation of accounts by individuals who enter a birth date indicating an age under 18.

 

a)     Any attempt to circumvent the age restriction such as submitting false information will be considered a violation of these Terms.

 

b)     If HaloScape becomes aware that an account has been created or accessed by a person under the age of 18, either directly or through verification systems, we reserve the right to immediately suspend or terminate the account without prior notice.

 

c)     Parents or legal guardians who become aware that a minor has provided personal data or accessed the Services are encouraged to contact us so that appropriate measures can be taken.

 

This policy reflects HaloScape’s commitment to protecting minors and complying with legal obligations regarding the processing of children’s personal data.

IV. Modifications

HaloScape reserves the right to update, revise, or amend these Terms of Use at any time, particularly in response to:

 

a)     changes in applicable laws or regulations,

b)     the introduction of new features, functionalities, or services, or

c)     modifications in our operational practices or company structure.

 

All modifications will be communicated clearly through one or more of the following channels:

a)     A notification within the HaloScape App,

b)     An announcement on the official HaloScape website, or

c)     A direct email to the address associated with your user account.

 

Your continued access to or use of the Services after the effective date of any such changes shall be deemed to constitute your full and irrevocable acceptance of the updated Terms. If you do not agree to the revised Terms, you must cease using the Services immediately and may delete your account as outlined in the termination provisions of these Terms.

V. Communications

HaloScape may send official communications, notifications, or important updates to Users through the following channels:

 

a)     The email address associated with the User’s registered account; and/or

b)     In-app messages or push notifications within the HaloScape platform.

 

Users are responsible for ensuring that their contact details, including their email address and device notification settings, are accurate and up to date. HaloScape is not liable for any missed or undelivered communications resulting from incorrect or outdated user information.

 

All electronic communications shall be deemed received and effective on the date of dispatch, regardless of whether the User actually reads or accesses the message.

VI. Applicable Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.

Where local consumer protection laws require the application of other legal provisions for the benefit of Users residing in different jurisdictions, such laws may prevail to the extent necessary.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of the HaloScape App and services, the Parties agree to first attempt an amicable resolution. If no resolution is reached, the dispute shall be submitted to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Enforcement Offices.

VII. Technical Requirements and Device Compatibility

To use the HaloScape App and its Services effectively, Users must ensure that their device meets the following minimum requirements:

a)     A compatible smartphone or tablet running at least iOS 18.0 or Android 10.0;

b)     An active internet connection (Wi-Fi or cellular);

c)     Sufficient storage capacity for App installation and data caching.

 

The HaloScape App is designed for use on standard mobile platforms such as iOS and Android. HaloScape does not guarantee compatibility with older versions of operating systems, jailbroken/rooted devices, or custom ROMs.

 

Users are responsible for keeping their device and operating system up to date. Failure to install mandatory App updates or use a supported device may result in limited functionality or loss of access to Services. HaloScape is not responsible for any errors or service interruptions caused by outdated or unsupported software or hardware.

 

Users are solely responsible for ensuring that their devices meet the technical criteria for proper App functionality. HaloScape shall not be held liable for any loss, malfunction, or data inaccuracy resulting from the use of unsupported or incompatible devices.

VIII. Prohibited Conduct and Platform Usage Rules

HaloScape is committed to maintaining a safe, respectful, and lawful environment for all Users and Professionals. By accessing the App and Services, you agree not to misuse the platform in any way. The following activities are strictly prohibited:

 

Legal and Ethical Violations

Users may not:

•                Use the Services for any purpose that violates applicable local, national, or international laws or regulations;

•                Post, transmit, or store content that is unlawful, defamatory, fraudulent, threatening, abusive, obscene, or otherwise inappropriate;

•                Infringe upon intellectual property, privacy rights, or data protection laws, including uploading or sharing content without proper rights or consent.

 

Technical Misuse and Security Breaches

Users may not:

•                Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to access the source code or internal logic of the App;

•                Bypass, tamper with, or disable any security features or access controls implemented by HaloScape;

•                Introduce viruses, worms, spyware, or other malicious software to the App or attempt to disrupt the normal functioning of the platform or connected systems;

•                Use unauthorized third-party tools, bots, scrapers, or similar technologies to extract data or interfere with App operations.

 

Unauthorized Commercial Use

Users may not:

•                Use the platform to promote or conduct unauthorized advertising, spam, or solicitations;

•                Reproduce, copy, sell, trade, or exploit any part of the Services for commercial purposes without prior written consent from HaloScape;

•                Offer or receive health-related services outside the platform using contact information obtained via HaloScape, unless explicitly allowed by HaloScape policy.

 

Account Misuse

Users may not:

•                Share login credentials with others or allow unauthorized persons to access their account;

•                Impersonate another person, falsify identity, or misrepresent affiliations, roles (e.g., claiming to be a certified professional), or qualifications;

•                Create multiple accounts for the purpose of abusing free trials, referrals, or bypassing usage restrictions.

 

Community Integrity and Trust

Users may not:

•                Harass, intimidate, stalk, or engage in any form of abusive behavior towards Professionals, Users, or HaloScape staff;

•                Record or distribute session content, messages, or health-related information without proper consent from all involved parties;

•                Submit false reports, manipulate ratings, or interfere with fair platform governance.

 

Enforcement

HaloScape reserves the right to investigate any suspected violations of these rules. If a violation is confirmed, HaloScape may take appropriate action, which may include:

•                Temporary or permanent suspension of the account;

•                Removal of content;

•                Reporting the matter to relevant authorities;

•                Legal action, including claims for damages.
